Terms & Conditions for Wheelsafar

These Terms & Conditions (“Terms”) govern your access to and use of the Wheelsafar mobile application (“App”), operated by Wheelsafar (“we”, “our”, or “us”).
By downloading, installing, or using the App, you agree to comply with these Terms. If you do not agree, please uninstall the App immediately.



Eligibility


To use Wheelsafar, you must:


  • Be at least 18 years old (or the age of majority in your region)

  • Have the legal authority to enter into this agreement

  • Provide accurate information during registration


We may suspend or terminate accounts that violate these conditions.


User Accounts & Responsibilities


When creating an account, you agree to:


  • Provide true, accurate, and updated information

  • Keep your login credentials confidential

  • Be responsible for all activity under your account

  • Notify us immediately of unauthorized access or breach


We are not liable for any loss due to compromised accounts.



App Usage & Restrictions


You agree not to:


  • Misuse the platform or disrupt operations

  • Create fake profiles or impersonate others

  • Upload harmful, illegal, or offensive content

  • Attempt to reverse engineer the App

  • Use automated systems to access data


We reserve the right to remove content or suspend users violating these rules.



Features & Service Availability


Wheelsafar provides:


  • Ride planning and management tools

  • Emergency features using Safesafar QR


We may modify or discontinue any feature without prior notice.



Location & Safety Responsibilities


Some app features rely on precise/approximate location. You understand and agree that:


  • Location accuracy may vary depending on network and device conditions

  • You are responsible for your personal safety during rides

  • Wheelsafar is not a substitute for safe riding practices or emergency services



Intellectual Property


All content, branding, graphics, code, and features in Wheelsafar are the property of Wheelsafar.
You may not copy, modify, distribute, or commercially exploit any part of the App without our written consent.



Third-Party Services


The App may include third-party:


  • APIs (e.g., Maps)

  • Payment systems

  • Analytics tools

  • Partner offerings


We are not responsible for third-party terms or privacy practices.



Termination


We may suspend or terminate access if:


  • You violate these Terms

  • Required by law or safety concerns

  • Fraudulent or harmful activity is detected


Upon termination, your right to use the App immediately ends.


You may delete your account anytime from settings or by contacting us.



Limitation of Liability


To the maximum extent permitted by law:


  • Wheelsafar is not liable for any personal injury, loss, or damages from using the App or services

  • Riders are fully responsible for compliance with traffic rules and personal safety

  • We do not guarantee uninterrupted or error-free service



Indemnification


You agree to defend and hold Wheelsafar harmless from

  1. Any claims

  2. Damages

  3. Legal expenses arising from:


  • Violation of these Terms

  • Misuse of the App or services

  • Any harm caused by your actions while riding or engaging with others via the App



Changes to Terms


We may update or replace these Terms at any time.
The latest version will always be available in the App.
Continued use of the App signifies acceptance of updated Terms.



Governing Law


These Terms are governed by the laws of India.
Any disputes will be handled in the courts of Pune, India.
